Pharmaceutical insurance

The Finnish Co-operative for Pharmaceutical Injury Indemnities has taken out a pharmaceutical insurance to protect medicine users. The purpose of the insurance is to indemnify the adverse effects that are unexpected in the therapeutic situation, caused to the users by the pharmaceuticals complying with the Medicines Act and distributed for consumption as well as the injuries caused by medicines in clinical trials in Finland.

Pharmaceutical insurance covers pharmaceuticals whose manufacturer, importer, distributer or marketer is a member of the Co-operative.  The insurance also covers investigational drugs used in clinical trials in Finland providing that the trials are conducted or sponsored by signatories to the insurance contract in accordance with legislation governing medical research. If a comparator used in a trial has been made by another manufacturer, the comparator is covered by the insurance if supplied for consumption in Finland by a signatory to the insurance contract.

If, during the use of a medicine, you experience symptoms that you suspect depend on the medicine, please follow the written instructions accompanying the medicine pack. The package leaflet describes the harmful side effects that the medicine may have and what should be done if one is affected.

Claim

Compensation for a drug injury can be applied for from the Finnish Mutual Insurance Company for Pharmaceutical Injury Indemnities. For this you must complete a claim form for compensation. Please discuss with the treating physician or with any other healthcare person before you report a drug injury. Such a call can help you determine whether a claim is warranted or not. Claims shall be made within one year of the date on which the person claiming compensation became aware of the validity of the Insurance, the injury caused by the pharmaceutical involved and the injured event. The claim form for compensation must be submitted no later than within 10 years from the occurrence of the injured event.

Other compensation schemes

The pharmaceutical insurance is a secondary system. The purpose of the insurance is to supplement the statutory compensation system. Therefore, from the benefits paid out of the insurance, benefits paid or received from statutory insurance or otherwise obtained by public funds are always deducted. Claims to statutory schemes must always be made to the relevant body (e.g. The Social Insurance Institution of Finland), even if compensation is sought from the Finnish Mutual Insurance Company for Pharmaceutical Injury Indemnities.
